ICJ ruling on Israel: A victory without a win

The International Court of Justice’s demand that Israel takes all measures to prevent genocidal acts in Gaza is an important first step towards ending the unimaginable suffering inflicted upon Palestinians for the past 111 days, and sends a vital message: Israel is not above international law.

Israel is now legally obligated to abide by a number of important provisional measures:

  1. Israel must take all measures to prevent any acts that could be considered genocidal – killing members of a group, causing bodily harm, inflicting conditions designed to bring about the destruction of a group, preventing births
  2. Israel must ensure its military does not commit any genocidal acts
  3. Israel must prevent and punish any public comments that could be considered incitement to commit genocide in Gaza
  4. Israel must take measures to ensure humanitarian access
  5. Israel must prevent any destruction of evidence that could be used in a genocide case
  6. Israel must submit a report to the court within one month of this order being given

No ceasefire

Despite the momentous decision not to dismiss South Africa’s case, as the Israeli government had requested, there was no call for a ceasefire to the ongoing conflict – the only measure that will ultimately halt Israel’s intentional and systematic destruction of the civilian population in Gaza.

The absence of such a ruling means that our call will only grow louder and stronger: ceasefire now.
